1. Agreement to Terms

By using Brilliance Digital Marketing services provided by Valerie Schmelzer Jeweler, Inc., you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services Description

Brilliance Digital Marketing provides specialized digital marketing services for jewelry businesses including:

  • Google Ads management and local SEO
  • Facebook and Instagram advertising
  • YouTube video marketing
  • TikTok content strategy and advertising
  • Website optimization and e-commerce setup
  • Professional jewelry photography
  • Analytics, tracking, and reporting
  • CRM integration and customer journey optimization

3. Service Packages

Boutique Package - $2,497/month:

  • For single-location jewelry stores
  • Google Ads campaign management
  • Local SEO optimization
  • Facebook & Instagram advertising
  • Monthly content creation (up to 8 posts)
  • Weekly performance reports
  • Email support (response within 24 hours)

Luxury Package - $4,997/month:

  • For established luxury jewelers
  • All Boutique package features
  • YouTube advertising campaigns
  • TikTok strategy and content creation
  • Professional jewelry photography (1 session/month)
  • CRM integration and automation
  • Priority support (response within 4 hours)

Enterprise Package - Custom Pricing:

  • For multi-location chains and brands
  • All Luxury package features
  • Multi-location campaign management
  • Dedicated account team (3+ specialists)
  • Custom video production (up to 2 videos/month)
  • Influencer partnership facilitation
  • 24/7 priority support with account manager

Setup Fee: $1,500 one-time (waived for 12-month commitments)

4. Payment Terms

Billing:

  • Services billed monthly in advance
  • Payment due on the 1st of each month
  • Accepted methods: Credit card, ACH, wire transfer
  • Late payments subject to 2% monthly interest
  • Service suspended for accounts 15+ days overdue

5. Client Obligations

  • Provide accurate business and billing information
  • Grant necessary access to advertising accounts
  • Maintain valid payment method on file
  • Respond to requests within 3 business days
  • Comply with platform advertising policies
  • Maintain separate advertising budget (our fees are management only)
  • Not hold us liable for account suspensions due to policy violations

6. Service Expectations

Important: Realistic Expectations

We do NOT guarantee specific sales numbers, conversion rates, ROI, ranking positions, or viral content performance. Marketing results depend on your products, pricing, market conditions, competition, budget, and platform algorithms.

  • Transparent reporting on all metrics
  • Proactive communication about performance
  • Continuous improvement efforts

7. Contract Term & Cancellation

  • Services are month-to-month (no long-term lock-in)
  • Either party may cancel with 30 days written notice
  • Cancellation must be submitted before the 1st of month
  • No refunds for partial months
  • All fees paid are non-refundable

Money-Back Guarantee:

  • Available for first 60 days only
  • Must provide documented proof of dissatisfaction
  • Refund excludes setup fee
  • Must give us opportunity to resolve issues first

8. Intellectual Property

Client Owns:

  • Ad copy and creative assets created for campaigns
  • Photography/videography of your products
  • Campaign strategies specific to your business
  • All performance data and analytics

We Retain Rights To:

  • Our proprietary processes and methodologies
  • General frameworks and templates
  • Anonymized aggregate data for service improvement
  • Case studies (with client permission only)

9. Limitation of Liability

To maximum extent permitted by law:

  • Total liability limited to fees paid in previous 3 months
  • Not liable for indirect, consequential, or punitive damages
  • Not liable for lost profits, revenue, or sales
  • Not liable for advertising account suspensions
  • Not liable for third-party platform actions or changes

10. Dispute Resolution

Governing Law: These Terms governed by laws of Ohio, USA. Disputes subject to courts of Cuyahoga County, OH.

Arbitration: If unresolved through negotiation, binding arbitration in Cleveland, OH under AAA commercial rules.
